These general terms and conditions of sale apply to the services provided by the establishment: any reservation implies acceptance of these terms and conditions by the client. Only the specific clauses of agreements signed with the client may supplement, clarify, or even deviate from these terms and conditions of sale.
I. Validity of the quote
This quote is valid for two months from the date of issue.
II. Billing
Prices are specified excluding VAT (HT) or including VAT (TTC). Their nature (fixed or variable) and amount are specified in the special conditions. Any additional services requested by the Client beyond the accepted quote will be subject to additional billing.
III. Payments and Down Payments
A deposit of €5,000 for semi-private events and €10,000 for private events is due upon signing the Contract. Any deposit paid will be retained in the event of cancellation if such cancellation occurs less than 15 days before the event date (see V- Cancellation).
The balance of the invoice must be paid no later than the day of receipt by check, bank transfer, or credit card. In the event of non-payment of the balance within the specified timeframe, SAS Son de la Terre reserves the right to deny the Client access to the private areas.
As a penalty clause and in accordance with legal provisions, any late payment will incur a penalty equal to three times the legal interest rate, as well as a fixed recovery fee of €40 (Article L441-6 of the French Commercial Code).
IV. Reservation Clause
We reserve the right to accept or refuse bookings at our sole discretion. We may refuse a booking if we believe the event does not align with our philosophy or brand image, or if the event could disrupt our regular business operations.
V. Clause prohibiting commercial activity
Customers are not permitted to use the premises of our establishment, SAS Son de la Terre, for any commercial or profit-making activities, such as selling products or services, collecting donations, or holding lotteries. Events must be exclusively for personal and non-commercial purposes. We reserve the right to immediately terminate any event that violates this clause, without prejudice to our right to claim damages for any financial loss or damage to our brand image.
VI. Caution
In the event of exclusive use of the venue, an inventory will be taken before and after the event.
A security deposit may be requested from the client (not cashed). If no damage is found, Son de la Terre SAS will return the deposit within 15 days of the event's conclusion. Otherwise, the matter will be discussed between Son de la Terre SAS and the client.
VII. Changes to the number of people and spaces
Any change to the number of people participating in the event must be made within the deadlines mentioned below:
• 1 to 5 people: 3 business days
• More than 20 people: 7 business days
If these deadlines are not met:
• If the number of participants is less than the number announced, the order will be invoiced.
• Conversely, if the number of participants is greater than the number announced, Son de la Terre SAS reserves the right to refuse this addition. If the request is accepted, a supplementary invoice will be issued.
VIII. Extension of the event
Extending the event beyond the stated time will result in additional charges for the following:
– Security guard and staff: €30 excluding VAT per hour per person.
– Son de la Terre SAS: €600 excluding VAT per hour
IX. Cancellation
In the event of cancellation, the deposit paid will not be refunded if the cancellation occurs less than 15 days before the event date. In the event of cancellation due to force majeure (COVID, curfew, etc.) that prevents the event from taking place, the deposit will be retained and the event will be postponed to a later date convenient to both parties, at no additional cost, including the following year.
X. Losses and breakages
In the event of loss or damage to equipment used during the reception, due to the Client, these costs will be billed directly to the Client.
XI. Territorial jurisdiction
Jurisdiction is conferred upon the Commercial Court of Paris, which shall have sole jurisdiction to the exclusion of any other, even in the event of a third-party claim or multiple defendants.
Concert ticket sales conditions: SAS Son de la Terre
1. Purpose
These general terms and conditions of sale govern the sale of tickets for events organised in the Son de la Terre concert hall (hereinafter referred to as "the Hall") and are subject to change without notice.
2. Tickets
2.1. Tickets are sold exclusively by the Venue or its authorized partners.
2.2. Tickets are sold for a specific event and are non-refundable, except in the event of cancellation. For any exchange requests, please contact hello@sondelaterre.fr. Ticket exchanges will be approved or denied by management based on availability. If the price differs, the ticket holder will be asked to pay the difference at the entrance. All exchange requests must be sent to hello@sondelaterre.fr no later than 4 hours before the start of the event.
2.3. Online ticket sales will close 30 minutes before the event. Any tickets purchased after this time will be available on-site, subject to availability.
2.4. Tickets will be checked upon presentation of the ticket in paper or electronic format. Without a ticket, identification will be required to verify the passenger list.
3. Prices and payments
3.1. Ticket prices are indicated in euros and include VAT.
3.2. Tickets can only be paid for by credit card, online or on site. Le Son de la Terre does not have a physical cash register at the entrance. Le Son de la Terre does not accept checks.
3.3. In the event of non-payment or partial payment, the Venue reserves the right to refuse access to the event.
3.4. Tickets may not be resold at a price higher than that shown on the ticket, in accordance with the law.
4. Access to the room
4.1. Access to the Hall is reserved for persons with a valid ticket for the event in question.
4.2. The venue reserves the right to refuse entry to any person who is intoxicated or under the influence of drugs, as well as to persons who are a threat to public order or security.
4.3. The opening hours of the Hall are indicated on the ticket and may be changed without notice if necessary.
4.4. A ticket grants access to one seat in the club area. In the case of a standing concert organized by the venue or the artist, seating is unassigned, subject to availability. For any questions regarding seating arrangements, please contact hello@sondelaterre.fr
4.5. If you are more than 30 minutes late, we consider that the ticket holder is absent and we can no longer guarantee a seat at a table.
5. Room Responsibility
5.1. The venue accepts no responsibility in case of loss or theft of tickets.
5.2. The venue declines all responsibility in the event of cancellation or postponement of the event for reasons beyond its control, including force majeure.
5.3. The Salle's liability can only be invoked for direct damages caused by its fault.
6. Intellectual Property
6.1. Intellectual property rights relating to events organised in the Venue (including copyrights) are the exclusive property of their respective owners.
6.2. Any reproduction, representation or use of elements protected by copyright is strictly prohibited, except with the express permission of the rights holder.
Applicable law and jurisdiction
These general terms and conditions of sale are governed by French law. Any dispute relating to their interpretation or performance shall be subject to the exclusive jurisdiction of the French courts.
