These general conditions of sale apply to the services provided by the establishment: any reservation implies on the part of the Customer the acceptance of these conditions. Only the specific clauses of the agreements signed with the customer will be able to complete, specify, or even derogate from these conditions of sale.
I. Validity of the quote
This quote is valid for two months following the date of issue.
II. Billing
The prices are specified HT (excluding tax) or TTC (all taxes included). Their nature (firm or revisable) and their amount are specified under the special conditions. All additional services to the accepted quote, requested by the customer, will be the subject of additional invoicing.
III. Payments and COMPLET
A deposit of 5000th for semi-privateizations and 10,000th for privatizations are due to the signing of the contract. Any deposit paid will be kept in the event of cancellation, if this cancellation occurs less than 15 days before the date of the event (see V- Cancellation).
The balance of the invoice must be paid no later than the day of reception by check, bank transfer or bank card. In the event of non-payment of the balance within the indicated deadlines, the SAS Son de la Terre reserves the right not to allow the customer access to private spaces.
As a penal clause and in application of legal provisions, any delay in payment will give rise to the application of a penalty equal to three times the legal interest rate, as well as to the payment of a flat-rate allowance for recovery costs of 40 euros (article L441-6 of the Commercial Code).
IV. Reservation clause
We reserve the right to refuse or accept reservations at our full discretion. We can refuse a reservation if we think that the event does not correspond to our philosophy or our brand image, or if the event could disrupt our regular activities.
V. Commercial activity prohibition clause
Customers are not authorized to use the space of our establishment, the SAS sound of the land to carry out commercial or lucrative activities, such as the sale of products or services, the collection of donations or the holding of lotteries. Events must be exclusively intended for personal and non -commercial purposes. We reserve the right to immediately end any event that would infringe this clause, without prejudice to our right to damages in the event of financial loss or prejudice to our brand image.
VI. Deposit
In the event of total privatization of spaces, an inventory will be carried out before and after the event.
A deposit may be requested from the customer (not cashed). In the absence of degradations, the SAS sound of the earth undertakes to destroy the deposit within 15 days after the end of the event. Otherwise, the situation will be discussed between the SAS sound of the land and the customer.
VII. Modification of the number of people and spaces
Any modification of the number of persons participating in the event must be made within the deadlines mentioned below:
• from 1 to 5 people: 3 working days
• Beyond 20 people: 7 working days
in the event of non-compliance with these deadlines:
• If the number of participants is lower than the number announced, the order will be invoiced
• If the opposite the number of participants is greater than the announced number, SAS If the request is accepted, an additional invoice will be published.
VIII. Extension of the event
The extension of the event beyond the mentioned schedule will result in additional invoicing on the following points:
-Vigil and staff: € 30 excl. Tax per hour and per personnel.
- The Son of the Earth: 600 € HT per hour
IX. Cancelation
In case of cancellation, the deposit paid will not be refunded if this cancellation occurs less than 15 days before the date of the event. In the event of cancellation linked to a case of force majeure (COVID, curfew, etc.) which would prevent the event from carrying out the event, the deposit is preserved and the event postponed to a later date suitable for both parties, without additional costs, including the following year.
X. Losses and breakages
In the event of loss and breakage of the equipment used during reception, due to the customer, these will be directly invoiced to him.
XI. Territorial jurisdictional competence
He is awarded competence to the Paris Commercial Court which will be solely competent to the exclusion of any other, even in the event of a guarantee or plurality of the defendants.
Conditions of sale of concert tickets: SAS Son de la Terre
1. Object
These General Conditions of Sale govern the sale of tickets for events organized in the Sound of the Earth concert hall (hereinafter referred to as "the room") and are likely to be modifications without notice.
2. Tickets
2.1. Tickets are sold exclusively by the room or its authorized partners.
2.2. Tickets are sold for a specific event and are not refundable, except in the event of cancellation of the event. For any exchange request, contact hello@sondelaterre.fr. Ticket exchanges will be validated or not by management depending on the available places. In the event of a different rate it will be requested from the ticket holder for an additional entry. Any exchange request will be made at hello@sondelaterre.fr no later than 4 hours before the start of the event.
2.3. The online ticket office will be closed 30 min preceding the event. Any purchase of space passed this period will be on site within the limits of available places.
2.4. Ticket control will be under presentation of the paper or electronic format ticket. Without presentation of tickets it will be requested an identity document in order to control the nominative list.
3. Price and payments
3.1. Ticket prices are indicated in euros and include VAT.
3.2. Payment of tickets can be made by bank card only, online or on site. The sound of the earth does not have a physical body at the entrance for cash collection. The sound of the earth does not accept checks.
3.3. In the event of non-payment or partial payment, the room reserves the right to refuse access to the event.
3.4. Tickets cannot be sold at a price higher than that appearing on the ticket, in accordance with the law.
4. Access to the room
4.1. Access to the room is reserved for people with a valid ticket for the event in question.
4.2. The Salle reserves the right to refuse access to any person in a state of drunkenness or under the influence of drugs, as well as to the persons affecting public order or security.
4.3. The opening hours of the room are indicated on the ticket and can be modified without notice if necessary.
4.4. A ticket gives access to a seat in the club space. In the case of a standing concert at the initiative of the room or the artist, the placement is free within the limits of available seats. For any questions relating to seats, please contact hello@sondelaterre.fr
4.5. Beyond 30 minutes late, we consider that the ticket holder is absent and we can no longer guarantee a place sitting at the table.
5.
5.1. The room declines any responsibility in the event of loss or theft of tickets.
5.2. The room declines any responsibility in the event of cancellation or postponement of the event for reasons independent of its will, in particular in the event of force majeure.
5.3. The responsibility of the room can only be engaged for direct damage caused by its fault.
6. Intellectual property
6.1. The intellectual property rights relating to events organized in the room (in particular copyright) are the exclusive property of their respective holders.
6.2. Any reproduction, representation or use of the elements protected by copyright is strictly prohibited, without the express authorization of the holder of the rights.
Applicable law and jurisdiction
These general conditions of sale are subject to French law. Any dispute relating to their interpretation or their execution will be of the exclusive jurisdiction of the French courts.
